Delegation of authority.
(a) In delegating implementation and enforcement authority to a State under section 112(d) of the Act, the authorities contained in paragraph (b) of this section shall be retained by the Administrator and not transferred to a State.
(b) Authorities which will not be delegated to States: Sections 61.53(c)(4) and 61.55(d). The authorities not delegated to States listed are in addition to the authorities in the General Provisions, subpart A of 40 CFR part 61, that will not be delegated to States ( §§ 61.04(b), 61.12(d)(1), and 61.13(h)(1)(ii) ).

      ENVIRONMENTAL PROTECTION AGENCY
      Direct final rule.
      This rule is effective on July 1, 2013 without further notice, unless EPA receives adverse comments by May 30, 2013. If we receive such comments, we will publish a timely withdrawal inthe Federal Register to notify the public that this direct final rule will not take effect.
