Arkansas Pollution Control and Ecology (APC&E) Commission Regulation No. 23, Hazardous Waste Management, as amended December 9, 2005, effective March 23, 2006. Please note that the 2006 APC&E Commission Regulation No. 23, is the most recent version of the Arkansas authorized hazardous waste regulations. For a few provisions, the authorized version is found in the APC&E Commission Regulation 23, dated January 21, 1996. Arkansas made subsequent changes to these provisions but these changes have not been authorized by EPA. The provisions from the January 21, 1996 regulations are noted below.

      This regulation is effective December 1, 2014, unless the EPA receives adverse written comment on the codification of the Arkansas authorized RCRA program by the close of business November 3, 2014. If the EPA receives such comments, it will publish a timely withdrawal of this direct final rule in the Federal Register informing the public that this rule will not take effect. The incorporation by reference of authorized provisions in the Arkansas statutes and regulations contained in this rule is approved by the Director of the Federal Register as of December 1, 2014 in accordance with 5 U.S.C. 552(a) and 1 CFR part 51.
