The following are ALL rules, proposed rules, and notices (chronologically) published in the Federal Register relating to 50 CFR 217 after this date.
GPO FDSys XML | Text type regulations.gov FR Doc. 2013-10700 RIN 0648-BC46 Docket No. 120820371-3366-01 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Proposed rule; request for comments. Comments and information must be received no later than June 6, 2013. 50 CFR Part 217 NMFS has received an application from the U.S. Department of the Air Force, Headquarters 96th Air Base Wing (U.S. Air Force), Eglin Air Force Base (Eglin AFB) for authorization to take marine mammals, by harassment, incidental to testing and training activities associated with Precision Strike Weapon (PSW) and Air-to-Surface (AS) gunnery missions, both of which are military readiness activities, at Eglin AFB, FL from approximately June 2013, to June 2018. Pursuant to Marine Mammal Protection Act (MMPA) and its implementing regulations, NMFS proposes regulations to govern that take. In order to implement the final rule and issue a Letter of Authorization (LOA), NMFS must determine, among other things, that the total taking will have a negligible impact on the affected species and stocks of marine mammals and will not have an unmitigable adverse impact on the availability of the species for subsistence use. NMFS' proposed regulations would set forth the permissible methods of take and other means of effecting the least practicable adverse impact on the affected species or stocks of marine mammals and their habitat. NMFS invites comments on the application and the proposed regulations.
GPO FDSys XML | Text type regulations.gov FR Doc. 2013-08124 RIN 0648-BB00 Docket No. 110801452-3176-04 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Final rule. Effective from June 1, 2013 through May 31, 2018. 50 CFR Part 217 NMFS, upon request of Port Dolphin Energy LLC (Port Dolphin), hereby issues regulations pursuant to the Marine Mammal Protection Act (MMPA) to govern the unintentional taking of marine mammals, by harassment, incidental to port construction and operations at its Port Dolphin Deepwater Port in the Gulf of Mexico, over the course of five years; approximately June 2013 through May 2018. These regulations, which allow for the issuance of Letters of Authorization for the incidental take of marine mammals during the described activities and specified timeframes, prescribe the permissible methods of taking and other means of effecting the least practicable adverse impact on marine mammal species or stocks and their habitat, as well as requirements pertaining to the monitoring and reporting of such taking.
