GPO FDSys XML | Text type regulations.gov FR Doc. 2012-3051 RIN 0648-BB14 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Proposed rule; extension of comment period. NMFS has extended the public comment period for this action from February 6, 2012, to February 21, 2012. NMFS must receive written comments and information no later than February 21, 2012. 50 CFR Part 218 On January 6, 2012, the NMFS published its proposed regulations to govern the take of marine mammals, by harassment, incidental to conducting operations of Surveillance Towed Array Sensor System (SURTASS) Low Frequency Active (LFA) sonar in areas of the world's oceans (with the exception of Arctic and Antarctic waters and certain geographic restrictions), from August 16, 2012, through August 15, 2017. The Federal Register notice indicated that written comments were due by February 6, 2012, which allowed 30 calendar days for public input. In response to a request from the Natural Resources Defense Council, NMFS has decided to extend the public comment period by 15 days, to February 21, 2012, which allows a total of 45 days for public input.
GPO FDSys XML | Text type regulations.gov FR Doc. 2012-1621 RIN 0648-BB53 Docket No. 111019636-2033-02 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Final rule. Effective on February 1, 2012. 50 CFR Parts 216 and 218 Between January 2009 and May 2011, pursuant to the Marine Mammal Protection Act (MMPA), NMFS issued twelve 5-year final regulations to govern the unintentional taking of marine mammals incidental to Navy training and associated activities. Additionally, in February 2009, pursuant to the MMPA, NMFS issued 5-year regulations to govern the unintentional taking of marine mammals incidental to U.S. Air Force (USAF) space vehicle and test flight activities from Vandenberg Air Force Base (VAFB). These regulations require the issuance of annual “Letters of Authorization” (LOAs). Since the issuance of the rules, the Navy realized that their evolving training programs, which are linked to real world events, necessitate greater flexibility in the types and amounts of sound sources that they use. NMFS now amends the regulations for the affected Navy training ranges to provide for additional flexibility and allow for LOAs with longer periods of validity. Similarly, NMFS now amends the regulations issued to VAFB in February 2009, to allow for greater flexibility regarding the types and amounts of missile and rocket launches that the USAF conducts.
GPO FDSys XML | Text type regulations.gov FR Doc. 2011-33600 RIN 0648-BB14 Docket No. 110808485-1534-01 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Proposed rule; request for comments. Comments and information must be received no later than February 6, 2012. 50 CFR Part 218 NMFS has received a request from the U.S. Navy (Navy) for authorization to take marine mammals, by harassment, incidental to conducting operations of Surveillance Towed Array Sensor System (SURTASS) Low Frequency Active (LFA) sonar in areas of the world's oceans (with the exception of Arctic and Antarctic waters and certain geographic restrictions), from August 16, 2012, through August 15, 2017. Pursuant to the Marine Mammal Protection Act (MMPA), NMFS is proposing regulations to govern that take and requests information, suggestions, and comments on these proposed regulations.
GPO FDSys XML | Text type regulations.gov FR Doc. 2011-29494 RIN 0648-BB53 Docket No. 111019636-1638-01 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Proposed rule; request for comments. Comments and information must be received no later than December 15, 2011. 50 CFR Parts 216 and 218 Between January 2009 and May 2011, pursuant to the Marine Mammal Protection Act (MMPA), NMFS issued twelve 5-year final regulations to govern the unintentional taking of marine mammals incidental to Navy training and associated activities. NMFS now proposes to amend the regulations for the affected Navy training ranges to provide for additional flexibility and allow for LOAs with longer periods of validity. Similarly, NMFS now proposes to amend the regulations issued to VAFB in February 2009, to allow for greater flexibility regarding the types and amounts of missile and rocket launches that the USAF conducts.
GPO FDSys XML | Text type regulations.gov FR Doc. 2011-12984 RIN 0648-BB03 Docket No. 110516281-1283-01 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Interim final rule; request for comments. Effective on May 24, 2011. Comments and information must be received no later than June 27, 2011. 50 CFR Part 218 In June 2009, pursuant to the Marine Mammal Protection Act (MMPA), NMFS issued two 5-year final regulations to govern the unintentional taking of marine mammals incidental to Navy training activities conducted in the Virginia Capes (VACAPES) and Jacksonville (JAX) range complexes off the East Coast of the U.S. These regulations, which allow for the issuance of “Letters of Authorization” (LOAs) for the incidental take of marine mammals during the specified activities and described timeframes, prescribe the permissible methods of taking and other means of effecting the least practicable adverse impact on marine mammal species or stocks and their habitat, as well as requirements pertaining to the monitoring and reporting of such taking. These rules quantify the specific amounts of training activities involving underwater detonations that will occur over the course of the 5-year rules, and indicate that marine mammal take may only be authorized in an LOA incidental to the types and amounts of training activities and explosives described. No language was included expressly allowing for deviation from those precise levels of training activities and amounts of explosives even if the total number of takes remain within the analyzed and authorized limits. Since the issuance of these rules, the Navy realized that their evolving training programs, which are linked to real world events, necessitate greater flexibility in the types and amounts of training events and explosives that they conduct and use. In response to this need, NMFS has, through this interim final rule, amended the VACAPES and JAX regulations to explicitly allow for greater flexibility in the types and amount of training activities that they conduct and explosives that they use.
GPO FDSys XML | Text type regulations.gov FR Doc. 2011-11793 RIN 0648-BA14 Docket No. 100817363-1137-02 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Final rule; correction. Effective May 4, 2011, through May 4, 2016. 50 CFR Part 218 On May 4, 2011, a final rule was published in the Federal Register announcing that NMFS had issued regulations to govern the unintentional take of marine mammals incidental to Navy training activities conducted in the Gulf of Alaska Temporary Maritime Training Activities Area. That document inadvertently omitted the MK-39 Expendable Mobile ASW Training Target (EMATT) from Table 1. In addition, Table 5 inadvertently omitted a column displaying the total number of takes authorized over the course of the 5-year rule. This document corrects those oversights. All other information is unchanged.
