GPO FDSys XML | Text type regulations.gov FR Doc. 2012-31066 RIN 0648-XZ59 Docket No. 101126590-2478-03 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Final rule. This final rule is effective on February 26, 2013. Replies to the request for information regarding designation of critical habitat for Arctic ringed seals must be received by February 26, 2013. 50 CFR Parts 223 and 224 We, NMFS, issue a final determination to list the Arctic ( Phoca hispida hispida ), Okhotsk ( Phoca hispida ochotensis ), and Baltic ( Phoca hispida botnica ) subspecies of the ringed seal ( Phoca hispida ) as threatened and the Ladoga ( Phoca hispida ladogensis ) subspecies of the ringed seal as endangered under the Endangered Species Act (ESA). We will propose to designate critical habitat for the Arctic ringed seal in a future rulemaking. To assist us in this effort, we solicit information that may be relevant to the designation of critical habitat for Arctic ringed seals. In light of public comments and upon further review, we are withdrawing the proposed ESA section 4(d) protective regulations for threatened subspecies of the ringed seal because we have determined that such regulations are not necessary or advisable for the conservation of the Arctic, Okhotsk, or Baltic subspecies of the ringed seal at this time. Given their current population sizes, the long-term nature of the primary threat to these subspecies (habitat alteration stemming from climate change), and the existing protections under the Marine Mammal Protection Act, it is unlikely that the proposed protective regulations would provide appreciable conservation benefits.
GPO FDSys XML | Text type regulations.gov FR Doc. 2012-31068 RIN 0648-XZ58 Docket No. 101126591-2477-03 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Final rule. This final rule is effective on February 26, 2013. Replies to the request for information regarding designation of critical habitat for the Beringia DPS must be received by February 26, 2013. 50 CFR Part 223 We, NMFS, issue a final determination to list the Beringia and Okhotsk distinct populations segments (DPSs) of the Erignathus barbatus nauticus subspecies of the bearded seal ( Erignathus barbatus ) as threatened under the Endangered Species Act (ESA). We will propose to designate critical habitat for the Beringia DPS in a future rulemaking. To assist us with this effort, we solicit information that may be relevant to the designation of critical habitat for the Beringia DPS. In light of public comments and upon further review, we are withdrawing the proposed ESA section 4(d) protective regulations for the Beringia and Okhotsk DPSs because we have determined that such regulations are not necessary or advisable for the conservation of the Beringia and Okhotsk DPSs at this time. Given their current population sizes, the long-term nature of the primary threat to these DPSs (habitat alteration stemming from climate change), and the existing protections under the Marine Mammal Protection Act, it is unlikely that the proposed protective regulations would provide appreciable conservation benefits.

Title 50 published on 2012-10-01
The following are ALL rules, proposed rules, and notices (chronologically) published in the Federal Register relating to 50 CFR 223 after this date.
GPO FDSys XML | Text type regulations.gov FR Doc. 2013-09943 RIN 0648-XC50 Docket No. 130213133-3133-01 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration 90-day petition finding, request for information, and initiation of status review. Information and comments on the subject action must be received by June 25, 2013. 50 CFR Parts 223 and 224 We, NMFS, announce a 90-day finding on two petitions to list the great hammerhead shark ( Sphyrna mokarran ) range-wide or, in the alternative, the Northwest Atlantic distinct population segment (DPS) or any other identified DPSs as threatened or endangered under the Endangered Species Act (ESA), and to designate critical habitat. We find that the petitions and information in our files present substantial scientific or commercial information indicating that the petitioned action may be warranted. We will conduct a status review of the species to determine if the petitioned action is warranted. To ensure that the status review is comprehensive, we are soliciting scientific and commercial information pertaining to this species from any interested party.
GPO FDSys XML | Text type regulations.gov FR Doc. 2013-07781 RIN 0648-XA79 Docket No. 111025652-3245-02 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Proposed rule; request for comments. Comments on this proposed rule must be received by June 4, 2013. Public hearing requests must be requested by May 20, 2013. 50 CFR Parts 223 and 224 In response to a petition submitted by WildEarth Guardians and Friends of Animals to list the species as threatened or endangered, we, NMFS, have completed a comprehensive status review under the Endangered Species Act (ESA) for the scalloped hammerhead shark ( Sphyrna lewini ). Based on the best scientific and commercial information available, including the status review report (Miller et al., 2013), and other information available since completion of the status review report, we have determined that the species is comprised of six distinct population segments (DPSs) that qualify as species under the ESA: Northwest Atlantic and Gulf of Mexico (NW Atlantic & GOM DPS); Central and Southwest Atlantic (Central & SW Atlantic DPS); Eastern Atlantic DPS; Indo-West Pacific DPS; Central Pacific DPS; and Eastern Pacific DPS. After reviewing the best available scientific and commercial information on the DPSs, we have determined that two DPSs warrant listing as endangered, the Eastern Atlantic and Eastern Pacific DPSs; two DPSs warrant listing as threatened, the Central & SW Atlantic and Indo-West Pacific DPSs; and two DPSs do not warrant listing at this time, the NW Atlantic & GOM DPS and the Central Pacific DPS. Any protective regulations determined to be necessary and advisable for the conservation of the threatened DPSs under ESA section 4(d) would be proposed in a subsequent Federal Register announcement. Should the proposed listings be finalized, we would also designate critical habitat for the species, to the maximum extent prudent and determinable. We solicit information to assist these listing determinations, the development of proposed protective regulations, and designation of critical habitat in the event these proposed DPSs are finally listed.
GPO FDSys XML | Text type regulations.gov FR Doc. 2013-07355 RIN 0648-XA98 Docket No. 1206013325-3262-02 DEPARTMENT OF COMMERCE, National Ocean and Atmospheric Administration 90-day petition finding. Scientific and commercial information pertinent to the petitioned action must be received by May 28, 2013. 50 CFR Parts 223 and 224 We, NMFS, announce a 90-day finding on a petition from WildEarth Guardians to list the sperm whale ( Physter macrocephalus ) as an endangered or threatened distinct population segment (DPS) in the Gulf of Mexico. We find that the petition presents substantial scientific or commercial information indicating that the petitioned action may be warranted. As a result, we hereby initiate a status review of sperm whales in the Gulf of Mexico to determine whether the petitioned action is warranted. To ensure that the status review is comprehensive, we are soliciting scientific and commercial information pertaining to this species and potential critical habitat from any interested party.
GPO FDSys XML | Text type regulations.gov FR Doc. 2013-04718 RIN 0648-XC38 Docket No. 121204680-3387-01 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Notice of 90-day petition finding, request for information. Information and comments on the subject action must be received by April 29, 2013. 50 CFR Parts 223 and 224 We (NMFS) announce a 90-day finding on a petition to list the humphead wrasse ( Cheilinus undulatus ) as threatened or endangered and designate critical habitat under the Endangered Species Act (ESA). We find that the petition presents substantial scientific or commercial information indicating that the petitioned action may be warranted. Accordingly, we will conduct a review of the status of this species to determine if the petitioned action is warranted. To ensure that the status review is comprehensive, for 60 days we are soliciting information pertaining to this species from any interested party.
GPO FDSys XML | Text type regulations.gov FR Doc. 2013-04150 RIN 0648-XT12 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Extension of public comment period; notice of public hearing. Comments and information regarding this proposed rule must be received by April 6, 2013. The public hearing will be held on Tuesday, March 12, 2013, from 6 to 9 p.m. in Silver Spring, MD. 50 CFR Parts 223 and 224 NMFS hereby extends the comment period on the proposed listing determinations of 66 reef-building coral species and the proposed reclassifications of elkhorn ( Acropora palmata ) and staghorn ( Acropora cervicornis ) corals under the ESA until April 6, 2013, and announces a public hearing to be held in Silver Spring, MD, on March 12, 2013.
GPO FDSys XML | Text type regulations.gov FR Doc. 2013-02786 RIN 0648-BC10 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Proposed rule; withdrawal. The proposed rule published on May 10, 2012 (77 FR 27411), is withdrawn as of February 7, 2013. 50 CFR Part 223 We (NMFS) have determined that a final rule to withdraw the alternative tow time restriction and require all skimmer trawls, pusher-head trawls, and wing nets (butterfly trawls) rigged for fishing to use turtle excluder devices (TEDs) in their nets is not warranted at this time. Thus, we are discontinuing our Environmental Review process under the National Environmental Policy Act (NEPA) and do not intend to prepare a Final Environmental Impact Statement for this Action. We therefore withdraw our proposed rule to require TEDs in these vessels published May 10, 2012, in the Federal Register .
GPO FDSys XML | Text type regulations.gov FR Doc. 2013-00809 RIN 0648-BC68 Docket No. 121210693-2693-01 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Proposed rule; notice of availability. The first meeting will be in Chico, CA on February 5, 2013, at the Chico Masonic Family Center, 1110 West East Avenue from 5:30 p.m. to 7:30 p.m. The second meeting will be in Fresno, CA on January 24, 2013, at the Fresno Metropolitan Flood Control District, Board Meeting Room, 5469 E. Olive Avenue from 5:30 p.m. to 7:30 p.m. (The public should park in the front parking area (rear parking area closes at 5:30 p.m. with no exit after that time) and enter the door located on the west side of the front building). The third meeting will be in Los Banos, CA on January 25, 2013 at the Los Banos Community Center, 645 7th Street from 2 p.m. to 4 p.m. 50 CFR Part 223 We, the National Marine Fisheries Service (NMFS), propose a rule to designate a nonessential experimental population of Central Valley spring-run Chinook salmon ( Oncorhynchus tshawytscha ) under section 10(j) of the Endangered Species Act (ESA) in portions of the San Joaquin River, and to establish take exemptions for the proposed nonessential experimental population for particular activities inside the experimental population's geographic range and outside of the current evolutionarily significant unit (ESU) designated boundary of the species in the San Joaquin River tributaries and in the Delta. A draft environmental assessment (EA) has been prepared on this proposed action and is available for comment (see ADDRESSES and INSTRUCTIONS section below).
GPO FDSys XML | Text type regulations.gov FR Doc. 2013-00700 RIN 0648-BB04 Docket No. 110427267-2708-02 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Final rule. The effective date of this rule is January 15, 2013. 50 CFR Part 223 We, the National Marine Fisheries Service (NMFS), are issuing a final rule to authorize the continued release of Middle Columbia River (MCR) steelhead ( Oncorhynchus mykiss ) that are currently being reintroduced as part of an ongoing reintroduction effort into the upper Deschutes River basin in portions of Jefferson, Crook, and Deschutes Counties, Oregon, and designate them as a nonessential experimental population (NEP) under the Endangered Species Act (ESA) of 1973. The geographic boundaries of the NEP extend upstream from Round Butte Dam on the Deschutes River (about river mile (RM) 110, river kilometer (rkm) 177) and all accessible reaches of the Deschutes River and its tributary Whychus Creek; on the Crooked River from its confluence with the Deschutes River upstream to Bowman Dam (RM 70, rkm 113) and all accessible tributaries between these points; and on the Metolius River from its confluence with the Deschutes River upstream to all accessible tributaries between these points. This NEP designation will have an expiration date 12 years from the effective date of this final rule. We anticipate providing a notice in the Federal Register about 1 year before the NEP designation is set to expire to provide adequate notice to the public.
GPO FDSys XML | Text type regulations.gov FR Doc. 2012-29350 RIN 0648-XT12 Docket No. 0911231415-2625-02 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Proposed rule; request for comments. Comments on this proposal must be received by March 7, 2013. See SUPPLEMENTARY INFORMATION for public hearing dates, times, and locations. 50 CFR Parts 223 and 224 We, NMFS, have completed comprehensive status reviews under the Endangered Species Act (ESA) of 82 reef-building coral species in response to a petition submitted by the Center for Biological Diversity (CBD) to list the species as either threatened or endangered. We have determined, based on the best scientific and commercial data available and efforts being made to protect the species, that 12 of the petitioned coral species warrant listing as endangered (five Caribbean and seven Indo-Pacific), 54 coral species warrant listing as threatened (two Caribbean and 52 Indo-Pacific), and 16 coral species (all Indo-Pacific) do not warrant listing as threatened or endangered under the ESA. Additionally, we have determined, based on the best scientific and commercial information available and efforts undertaken to protect the species, two Caribbean coral species currently listed warrant reclassification from threatened to endangered. We are announcing that 18 public hearings will be held during the public comment period to provide additional opportunities and formats to receive public input. See SUPPLEMENTARY INFORMATION for public hearing dates, times, and locations.
GPO FDSys XML | Text type regulations.gov FR Doc. 2012-24930 RIN 0648-XA98 Docket No. 1206013326-2490-01 DEPARTMENT OF COMMERCE, National Oceanic and Atmospheric Administration Notice of 90-day petition finding, request for information. Information and comments on the subject action must be received by December 10, 2012. 50 CFR Parts 223 and 224 We (NMFS) announce a 90-day finding on a petition to list Nassau grouper ( Epinephelus striatus ) as threatened or endangered under the Endangered Species Act (ESA). We find that the petition presents substantial scientific or commercial information indicating that the petitioned action may be warranted. Accordingly, we will conduct a review of the status of this species to determine if the petitioned action is warranted. To ensure that the status review is comprehensive, we solicit information pertaining to this species from any interested party.
