To be incompatible means that there are persistent and unresolvable differences or irreconcilable conflicts between spouses that make it impossible to continue living together as spouses. Every state now recognizes this to be grounds for no-fault divorce, and some states will use the terms irreconcilable differences or irremediable or irretrievable breakdown. It usually results from a conflict of personality and character. If one party asserts a divorce and the incompatibility is proven through evidence, the court will grant the divorce even if the other party is unwilling to divorce.
