indefeasible

Primary tabs

Indefeasible refers to a legal right that has been granted for certain without any conditions. The term most commonly refers to a future property interest that does not have any condition precedent or future contingency. The term can be confusing and is part of a long tradition in property law that places heavy emphasis on specific words. Indefeasible property interests, such as indefeasibly vested remainders, are the most secure types of future interest in property where the person absolutely will receive the property and keep it. This is in contrast to other future interests that either have a requirement or end under certain circumstances such as life estates or contingent remainders.
