A property tort is a sub-category of torts relating to damage to property. It is an unlawful interference by one person, of another’s enjoyment of their private property. It arises when the right invaded is a property right rather than a personal right. Property torts include:

  • Trespass on land (entering someone's land without permission),
  • Trespass to chattels (handling items owned by another person without their permission), and
  • Conversion (taking possession of someone else's property with the intent of not returning it).
