(a) An agency may appoint noncompetitively a National Guard technician who -
(1) Was involuntarily separated (other than by removal for cause on charges of misconduct or delinquency);
(2) Has served at least 3 years as a technician;
(3) Meets the qualifications requirements of the job: and
(4) Is appointed within 1 year after separating from service as a Guard Technician.
(b) The noncompetitive appointing authority also applies to National Guard technicians separated before October 29, 1986, provided they are appointed within a year of the date of separation.

The U.S. Office of Personnel Management (OPM) is issuing a final rule on creditable service for career tenure. The final regulation removes the requirement for creditable service to be substantially continuous and instead allows an individual to attain career tenure after completing at least 3 years of total creditable service.
The U.S. Office of Personnel Management (OPM) is issuing a proposed regulation limiting to one the number of permanent appointments spouses of 100 percent disabled and spouses of deceased members of the Armed Forces may receive under these provisions. The Office of Personnel Management (OPM) is issuing final regulations implementing the Pathways Programs established by E.O. 13562, signed December 27, 2010. As directed by the President, the Pathways Programs provide clear paths to Federal internships and potential careers in Government for students and recent graduates. The Pathways Programs consist of the Internship Program, the Recent Graduates Program and the Presidential Management Fellows Program. Positions in the Pathways Programs are excepted from the competitive service. Participants in these Programs are appointed under the newly created Schedule D of the excepted service.
