(2) Foreign branch has the meaning set forth in 240.3a71-3(a)(2). (3) Transaction conducted through a foreign branch has the meaning set forth in 240.3a71-3(a)(3). (4) U.S. person has the meaning set forth in 240.3a71-3(a)(4). (5) U.S. major security-based swap participant means a major security-based swap participant, as defined in section 3(a)(67) of the Act (15 U.S.C. 78c(a)(67)), and the rules and regulations thereunder, that is a U.S. person. (6) Foreign major security-based swap participant means a major security-based swap participant, as defined in section 3(a)(67) of the Act (15 U.S.C. 78c(a)(67)), and the rules and regulations thereunder, that is not a U.S. person.
