qualifying pesticide chemical residue

(1) “Qualifying pesticide chemical residue” defined For purposes of this subsection, the term “qualifying pesticide chemical residue” means a pesticide chemical residue resulting from the use, in production, processing, or storage of a food, of a pesticide chemical that is an active ingredient and that— (A) was first approved for such use in a registration of a pesticide issued under section 3(c)(5) of the Federal Insecticide, Fungicide, and Rodenticide Act [ 7 U.S.C. 136a(c)(5) ] on or after April 25, 1985 , on the basis of data determined by the Administrator to meet all applicable requirements for data prescribed by regulations in effect under that Act [ 7 U.S.C. 136 et seq.] on April 25, 1985 ; or (B) was approved for such use in a reregistration eligibility determination issued under section 4(g) of that Act [ 7 U.S.C. 136a–1(g) ] on or after August 3, 1996 .
