(9) “operator” means— (a) in the case of a ship, a charterer by demise or any other person, except the owner, who is responsible for the operation, manning, victualing, and supplying of the vessel, or (b) in the case of a terminal, any person, except the owner, responsible for the operation of the terminal by agreement with the owner;
