(5) Vessel subject to the jurisdiction of the united states .— The term “vessel subject to the jurisdiction of the United States” has the meaning given that term in section 70502(c), except that it does not include a vessel that is— (A) owned, or operated under a bareboat charter, by the United States, a State or political subdivision thereof, or a foreign nation; and (B) not engaged in commerce.
