Hurd v. Hurd involved a dispute over child custody and a parent’s request to relocate with three minor children after the dissolution of the parties’ marriage. According to Ariz. Rev. Stat. § 25-403.03, a significant history of domestic violence is sufficient to render joint custody inappropriate.
In re the Marriage of Skains involved a dispute over child custody and parenting time following a dissolution of marriage between the petitioner and the respondent, who had three minor children. After the parties initially agreed to a custody evaluator’s recommendation for joint legal custody, the respondent obtained a protection order against the petitioner after an incident of domestic violence. The order prohibited the petitioner from contacting one child.
