For years, the appellant lived with his civil wife in the same apartment (in Ukraine, the term 'civil marriage' means cohabitation of a man and a woman without official marriage registration). While intoxicated one evening, he began to accuse his wife of cheating on him with other men and degrading his honor and dignity as a man. After a verbal conflict, the man, decided to kill his wife. In order to cause the most severe physical pain, he purposefully poured sulfuric acid from a bottle on his wife and verbally wished for her death, causing serious chemical burns.

The plaintiff sued her ex-husband and asked the court to evict her ex-husband, the defendant-appellant. The plaintiff owned half of the house and the other half of the house belonged to her brother. After the divorce, the defendant-appellant lived in the same house without becoming a joint owner. The defendant-appellant systematically caused moral and physical suffering to the plaintiff and violated the rules of cohabitation.

On five occasions from 2007 to 2013, the applicant's ex-husband inflicted injuries on the applicant, which the domestic authorities classified as minor bodily injuries. The police and the prosecutor's office repeatedly refused to open criminal proceedings due to the lack of evidence. In 2012, the offender was convicted of committing a crime under Article 125 of the Criminal Code of Ukraine (intentional minor bodily injury) because criminal liability for domestic violence (Article 126-1 of the Criminal Code of Ukraine) was not legislated until 2017 in Ukraine.

This report from HealthRight International (full title in English: Analytical report according to the results of the study on the dependence between the committed crime, domestic violence, gender-related violence among convicted women with experience of using drugs, using mixed methods) demonstrates a correlation between domestic violence (or any other type of violence) against women and subsequent commission of crimes by these women (based on a survey among women serving sentences in Chernihiv and Kachaniv prisons).

The man was accused of intentionally pouring sulfuric acid on his minor daughter, causing her severe bodily harm in the form of chemical burns to her head, face and other parts of her body. In addition, during the trial, it was found out that when the girl was 13-14 years old, her father committed lewd acts of a sexual nature with her over a long period of time. During the trial, the man did not admit his guilt.

In January-June 2022, in 83% of cases, victims of domestic violence were women.

The study was prepared based on the results of a survey conducted among women that were subjected to domestic violence, as well as on a qualitative analysis of Ukrainian legislation.

In the report, the experts drew attention to the fact that only 15% of law enforcement officers identify child witnesses as victims of domestic violence.

The report features quantitative and qualitative indicators of crimes committed in Ukraine in 2022 on the grounds of homophobia and transphobia taking into account the ongoing war. A total of 77 cases were documented, of which 31 cases were war crimes committed by the Russian occupiers and 2 cases happened to Ukrainian LGBTIQ refugees abroad.
