Abankwah v. Immigration & Naturalization Serv.

Ms. Abankwah, a native of Ghana, was a member of a tribe that punishes women who engage in premarital sex with female genital mutilation (“FGM”). While Ms. Abankwah was away from her tribe, she had a sexual relationship. Subsequently, she learned that she would be the next Queen Mother of her tribe, a position that requires a woman to remain a virgin until marriage. She knew this meant the tribe would discover she had engaged in premarital sex and she would be punished with FGM. Ms. Abankwah fled but her tribe came after her.

KHO 2019:93

Supreme Administrative Court (2019)

The issue in KHO 2019:93 was whether an asylum seeker was allowed to present new grounds for their asylum application in the Supreme Administrative Court. The Finnish Immigration Service rejected the application for asylum and residence permit of a Somali citizen and her daughter and decided to deport them to Somalia. The Administrative Court dismissed their appeal.

Ley nº 21.325 de 2021 Migración y Extranjería (protecting foreign women from gender-based violence)

Law No. 21,325/2021 governs migration and immigrants in Chile and includes specific provisions to protect foreign women from gender-based violence and discrimination. The State is required to ensure that migrant women are not discriminated against or subjected to violence at any stage of the migration process. The law also guarantees their access to institutions and protection mechanisms that safeguard their well-being. Special protection is granted to pregnant women, victims of human trafficking, victims of gender-based or domestic violence, and persons subjected to migrant smuggling.
