The Alabama Constitution contains several provisions relevant to matters of reproduction, marriage, and freedom of religion.
The Alaska State Constitution is the fundamental governing document of the State of Alaska, serving as the supreme law of Alaska, subordinate only to the U.S. Constitution and federal law. It establishes the framework of state government, defines the powers and responsibilities of its legislative, executive, and judicial branches, secures individual rights through a Declaration of Rights, and sets rules for resource management, local government, and public finance.
The Marriage Act of Finland was revised in 2017, after which the Marriage Act became gender-neutral. The Marriage Act ensures equal rights to marry regardless of gender identity, allowing two adults to enter into marriage. The term "spouse" is used in civil ceremonies instead of "husband" and/or "wife.” Additionally, the law allows registered partnerships to be converted into marriages and allows same-sex married couples to adopt children together.
The plaintiffs in Bostic v. Schaefer, 760 F.3d 352 (4th Cir. 2014), were two same-sex couples (one unmarried and seeking a marriage license, one married and seeking legal recognition) who sought to overturn Virginia’s prohibitions against same-sex marriage.
Civil Same Sex Marriage (2010)
In 2010 the Portuguese Parliament passed a law permitting same sex marriage, altering the corresponding articles of the Civil Code.
The Chilean Civil Code, enacted in 1855, has undergone significant reforms to expand rights and promote equality. In 2022, through Law No. 21,400, Chile legalized same-sex marriage, granting same-sex couples the same marital and family rights as opposite-sex couples, including adoption rights. The Civil Code also prohibits discrimination based on sexual orientation and gender identity, reaffirming the principle of equality before the law.
Articles 172, 402, and 509 of the Civil and Commercial Code protect same-sex marriage and civil unions in Argentina. Before the new, combined Civil and Commercial Code was promulgated in 2014, Law 26618 codified marriage equality by amending Article 172 of the then-current Civil Code (among other amendments), which provides that marriage has the same requirements and effects, regardless of the sex of the parties.
Article I, Section 15-A of the Virginia Constitution, known as the Marshall/Newman Amendment, limits marriage to the union of one man and one woman. It also barred same-sex couples from marrying in Virginia and prohibited recognition of same-sex marriages that were performed in other jurisdictions.
In Ex parte State ex rel. Alabama Policy Institute (2015), the Supreme Court of Alabama intervened in the state’s handling of same-sex marriage following federal district court rulings striking down Alabama’s marriage ban.
