Código Civil y Comercial Arts. 558-564 (2014) on Parentage

Articles 558 through 564 of the Civil and Commercial Code define the methods that establish parentage and describe parentage via medically assisted reproduction. In Argentina, parentage can be established via natural birth, via medically assisted reproduction, or via adoption (Article 558). The government must not label or differentiate birth certificates by parentage method (Article 559).

Lag 2021:783 Ändring i Föräldrabalken om föräldraskapspresumtion (presumption of parenthood)

The Amendment to the Parental Code (2021:783) on the presumption of parenthood, effective January 1, 2022, expands the presumption of parenthood to include married female couples as well as married couples in which one or both spouses have undergone a legal gender transition. This aligns the law with the presumption already applied to heterosexual married couples. Under Chapter 1, Section 9 of the Parental Code, a woman who is married to or in a registered partnership with the birth mother is automatically presumed to be the child’s other legal parent.

Partanen v. Gallagher, 475 Mass. 632 (2016)

A woman sought to be recognized as the legal parent of two children conceived by her former partner through in vitro fertilization during their long-term relationship. They were never married. Although the woman was not biologically related to the children and had not formally adopted them, she helped plan their conception, was present at their births, lived with them, and shared in their upbringing, financial support, and public representation as their mother.
