This report by LGBT Human Rights Center “Our World” contains a comprehensive analysis of the situation of the LGBTQ community in various spheres of social life, including relations with state and law enforcement agencies, the church, and the general public. The experts also investigated violations committed by the occupation authorities. The authors draw attention to legislative shortcomings in Ukraine in terms of regulating the status of LGBTQ communities. For example, Ukraine still has not introduced the mechanism of registered partnerships by adopting an appropriate law decreeing that a registered partnership is a registered family union of two adults of the same or different sexes based on mutual respect, mutual understanding, mutual support, and mutual rights and obligations. At the same time, such legislative changes are currently impossible due to the introduction of martial law in Ukraine: marriage is defined in the Constitution of Ukraine as a union between a woman and a man, and amending it during wartime is prohibited, as is adopting laws that contradict the Constitution. It should also be mentioned that Ukrainian churches continue to oppose efforts aimed at the protection of LGBTQ rights. For example, after the ratification of the Istanbul Convention, they unsuccessfully tried to organize a public campaign to denounce it. As for crimes committed by the occupying power against the LGBTQ community, most of them took place at checkpoints and along the patrol routes of Russian troops in the occupied territory (17 cases of torture; 31 cases of prejudice; 10 cases of sexual violence). The most common violations by individuals involve insults, humiliation, and threats. In regards to employment, the following types of violations were documented: coercing people into quitting and prejudicial treatment. In healthcare, two 2022 instances were documented of patients denied treatment because of their sexual orientation.
Дослідження містить комплексний аналіз становища ЛГБТ-спільноти в різних сферах суспільного життя, включаючи відносини з державними та правоохоронними органами, церквою та громадськістю. Експерти також дослідили порушення, що здійснюються російською окупаційною владою. Автори звертають увагу на законодавчі недоліки в Україні в частині регулювання статусу ЛГБТ-спільнот. Наприклад, в Україні досі не запроваджено механізм зареєстрованого партнерства шляхом прийняття відповідного закону, який би визначав, що зареєстроване партнерство - це зареєстрований сімейний союз двох повнолітніх осіб однієї або різної статі, заснований на взаємній повазі, взаєморозумінні, взаємній підтримці, взаємних правах та обов'язках. Водночас, такі законодавчі зміни наразі неможливі через запровадження воєнного стану в Україні: шлюб визначається Конституцією України як союз між жінкою і чоловіком, і внесення змін до неї під час воєнного часу заборонено, як і прийняття законів, що суперечать Конституції. Слід також зазначити, що українські церкви продовжують протидіяти зусиллям, спрямованим на захист прав ЛГБТ. Наприклад, після ратифікації Стамбульської конвенції вони безуспішно намагалися організувати публічну кампанію з її денонсації. Що стосується злочинів, скоєних окупаційною владою проти ЛГБТ- спільноти, то більшість з них сталися на блокпостах та вздовж маршрутів патрулювання російських військ на окупованій території (17 випадків катувань; 31 випадок упередженого ставлення; 10 випадків сексуального насильства).
