Дослідження щодо насильства проти жінок в Україні. Добробут і безпека жінок (Study on violence against women in Ukraine: Welfare and security of women, OSCE)

The study was prepared based on the results of a survey conducted among women that were subjected to domestic violence, as well as on a qualitative analysis of Ukrainian legislation. Having analyzed the results, the experts discovered the following notable trends: (i) over a quarter of the women (26%) have experienced physical and/or sexual violence at the hands of a current or previous partner; (ii) the interviewees consider psychological violence to be a normal phenomenon; also, 26% of the women consider domestic violence a personal matter (society as a whole demonstrates a certain degree of tolerance toward this); (iii) more than four in five women (81%) that reported experiencing the most serious incidents did not contact the police or any other agency. The experts also draw attention to legislative gaps in Ukrainian legislation combating violence against women. One of the issues is the impossibility of prosecuting domestic violence in Ukraine ex officio ('ex officio' meaning that the investigation occurs regardless of whether the injured party reported the crime or not; the victim may not withdraw the report and the crime will still be investigated). Thus, Article 477 of the Criminal Procedure Code contains a provision according to which investigations into instances of domestic violence are carried out in the form of a private indictment (i.e., the investigation can be initiated only at the request of the victim). As a result, given the above statistics, offenders often remain unpunished (victims often decide against going to the police because of fear or shame). In accordance with the Istanbul Convention, which Ukraine ratified on June 20, 2022 (Article 55 of the Convention), the state must ensure that instances of physical and sexual violence (which can be types of domestic violence) are investigated by competent authorities regardless of whether the victim files a report. The experts concluded that Ukrainian legislation conflicts with international law. They also drew special attention to the lack of shelters and the shortcomings in working with the offenders.

Експерти також звертають увагу на законодавчі прогалини в українському законодавстві у сфері протидії насильству щодо жінок. Однією з таких проблем є неможливість переслідування домашнього насильства в Україні ex officio ("ex officio" означає, що розслідування відбувається незалежно від того, чи повідомила потерпіла сторона про злочин, чи ні; потерпіла сторона не може забрати заяву, і злочин все одно буде розслідувано). Так, стаття 477 Кримінального процесуального кодексу містить положення, згідно з яким розслідування випадків домашнього насильства здійснюється у формі приватного обвинувачення (тобто розслідування може бути розпочато лише за заявою потерпілої особи). Як наслідок, з огляду на наведену вище статистику, кривдники часто залишаються непокараними (жертви часто відмовляються звертатися до поліції через страх або сором). Відповідно до Стамбульської конвенції, яку Україна ратифікувала 20 червня 2022 року (стаття 55 Конвенції), держава має забезпечити, щоб випадки фізичного та сексуального насильства (які можуть бути різновидами домашнього насильства) розслідувалися компетентними органами незалежно від того, чи подала жертва заяву. Експерти дійшли висновку, що українське законодавство суперечить міжнародному праву. Вони також звернули особливу увагу на брак притулків та недоліки в роботі з кривдниками.
