The plaintiff sued his wife, the defendant, to have his name as the father removed from a birth certificate. The child was born through the use of assisted reproductive technology (“ART”). The issue arose due to the fact that the doctors, without notifying either of the parents, performed the artificial insemination procedure on the defendant using material from other donors, as a result of which the child was not related by blood to either the father or the mother (the parents had given consent to the use of their biological material for artificial insemination, but no separate consent, as required by Ukrainian law, to the use of the genetic material of third parties). The court of first instance rejected the husband's demands, citing part 5, Art. 136 of the Family Code of Ukraine, which states that the person registered as the father of a child who has given written consent to the use of ART may not dispute paternity. According to the court, (i) registering the plaintiff as the child’s father is the natural legal consequence of the fact that he consented to the use of ART; (ii) the plaintiff was supposed to weigh all personal risks before providing his consent to the use of ART, not a month after the child was born. The appellate court overturned this decision and delivered a new one, stating that the case materials provided no evidence that the plaintiff had given a separate written consent to the use of biological material from third-party donors and that, since the plaintiff was not the biological father of the child, his demand to remove the record that named him as the father was justified. The Supreme Court upheld the appellate court’s decision, adding that consent of spouses to the use of specific types of ART is of paramount importance, as it determines the presence or absence of blood ties between the child and their parents.
Позивач подав до суду на свою дружину, відповідачку, з вимогою викреслити його ім'я як батька дитини зі свідоцтва про народження. Дитина була народжена за допомогою допоміжних репродуктивних технологій (ДРТ). Питання виникло у зв'язку з тим, що лікарі, не повідомивши жодного з батьків, провели відповідачу процедуру штучного запліднення з використанням матеріалу інших донорів, внаслідок чого дитина не була пов'язана кровною спорідненістю ні з батьком, ні з матір'ю (батьки дали згоду на використання їх біологічного матеріалу для штучного запліднення, але не дали окремої згоди, як того вимагає законодавство України, на використання генетичного матеріалу третіх осіб). Суд першої інстанції відмовив у задоволенні вимог чоловіка, посилаючись на ч. 5 ст. 136 Сімейного кодексу України. 136 Сімейного кодексу України, в якій зазначено, що особа, яка записана батьком дитини і дала письмову згоду на застосування ДРТ, не може оспорювати батьківство. На думку суду, (i) запис позивача як батька дитини є природним правовим наслідком того факту, що він дав згоду на застосування ДРТ; (ii) позивач повинен був зважити всі особисті ризики до надання згоди на застосування ДРТ, а не через місяць після народження дитини. Апеляційний суд скасував це рішення і ухвалив нове, вказавши, що матеріали справи не містять доказів того, що позивач надавав окрему письмову згоду на використання біологічного матеріалу від сторонніх донорів, і що, оскільки позивач не є біологічним батьком дитини, його вимога вилучити запис про те, що він є батьком, є обґрунтованою. Верховний Суд підтримав рішення апеляційного суду, додавши, що згода подружжя на застосування конкретних видів ДРТ має першорядне значення, оскільки визначає наявність або відсутність кровного зв'язку між дитиною та її батьками.
