Reiwa 3 (Gyo-Hi) No. 285 Seeking Revocation of Administrative Decision and State Compensation
The appellant, a transgender woman who was legally registered as male, was an employee of the Ministry of Economy, Trade and Industry. Under Article 86 of the National Public Service Act, she requested that the National Personnel Authority allow her unrestricted use of women’s restrooms at her workplace. The request was denied, and she challenged the administrative decision in court. The Supreme Court held that, under the specific circumstances of the case, the decision constituted an abuse of discretion by the National Personnel Authority and was therefore unlawful. The Court granted the appellant’s claim.
上告人は性同一性障害と診断され、戸籍上は男性であるが女性として生活する経済産業省の職員であった。上告人は国家公務員法86条に基づき、人事院に対し職場において女性用トイレの使用に制限を設けないよう要求したが、要求は認められなかった。これに対し上告人は判定の取消しを求めて訴えを提起した。最高裁判所は、本件の具体的事情において人事院の判定は裁量権を逸脱・濫用しており違法であると判断し、上告人の請求を認めた。
