ADPF 779 MC-REF/DF – Supremo Tribunal Federal (2021)
The Federal Supreme Court (STF), unanimously, declared the so-called “honor defense” unconstitutional, holding that it violates the principles of human dignity, the protection of life, and gender equality. The ruling was issued in the context of a Claim of Breach of Fundamental Precept (ADPF) 779, filed by the Democratic Labor Party (PDT), following a preliminary injunction granted by Justice Dias Toffoli in February 2021. The PDT argued against inconsistent state court rulings, some of which had upheld and others had overturned jury verdicts acquitting defendants of femicide on the basis of this argument. In reaffirming the injunction, the STF excluded the “honor defense” from the scope of legitimate self-defense under both the Penal Code and the Code of Criminal Procedure. Justice Toffoli described the doctrine as an odious, inhumane, and cruel argument, as well as discriminatory against women.
O Supremo Tribunal Federal (STF), por unanimidade, declarou inconstitucional a tese da “legítima defesa da honra”, por entender que ela afronta os princípios da dignidade da pessoa humana, da proteção à vida e da igualdade de gênero. A decisão foi proferida no âmbito da Arguição de Descumprimento de Preceito Fundamental (ADPF) 779, ajuizada pelo Partido Democrático Trabalhista (PDT), após o ministro Dias Toffoli conceder liminar em fevereiro de 2021. O partido sustentava que havia inconsistência nas decisões de Tribunais de Justiça, que em alguns casos validavam e em outros anulavam vereditos do Tribunal do Júri que absolviam réus de feminicídio com base nessa tese. Ao referendar a liminar, o STF excluiu a legítima defesa da honra do âmbito da legítima defesa previsto no Código Penal e no Código de Processo Penal. O ministro Toffoli qualificou a tese como um argumento odioso, desumano, cruel e discriminatório contra as mulheres.
