Alaska Statutes § 18.65.850 on Protective Orders for Stalking and Sexual Assault

Section 18.65.850 of the Alaska statutes allows a person who reasonably believes they are a victim of stalking or sexual assault (outside the context of domestic violence) to petition a district or superior court for a protective order. The court must schedule a hearing, provide at least ten days’ notice to the respondent, and if it finds by preponderance of evidence that stalking or sexual assault has occurred, may prohibit the respondent from threatening or committing those acts, restrain communication, order the respondent to stay away from the petitioner’s workplace, residence, school, or other designated places, and grant other protective relief. The order lasts for one year unless dissolved earlier, and may be extended following a timely petition and hearing.
