Arizona Revised Statutes § 15-112 Prohibited Courses and Classes

Arizona Revised Statutes § 15-112 regulates public school curriculum by prohibiting school districts and charter schools from offering courses or classes that promote the overthrow of the United States government, promote resentment toward a race or class of people, are designed primarily for students of a particular ethnic group, or advocate for ethnic solidarity rather than treating all students as individuals. The statute authorizes the state board of education or the superintendent of public instruction to determine noncompliance, to provide notice, and to allow sixty days to cure any violation. If a school fails to comply within that period, the State Board of Education may withhold up to ten percent of the school’s monthly state aid until compliance is achieved, at which point full funding will be restored. The statute provides for administrative hearings at state expense and permits appeals under Arizona administrative law. It also contains explicit exemptions, clarifying that the law does not restrict federally required courses for indigenous students, academic grouping that may have a disparate ethnic impact, open courses covering the history of any ethnic group, discussions of controversial historical topics, or instruction on the Holocaust, genocide, or historical oppression of particular groups.
