Section 13 Para 3 of the Introductory Act to the German Civil Code ( Einführungsgesetz zum bürgerlichen Gesetzbuch - EGBGB) - entered into force on July 22, 2017
Section 13, Para 3 of the Introductory Act to the German Civil Code is the central provision for preventing child marriages. Section 13, Para 3 No. 1, Introductory Act to the German Civil Code determines that marriages validly concluded abroad are invalid under German law if one of the parties to the marriage had not yet reached the age of 16 at the time of the marriage. Section 13 Para 3 No. 2 Introductory Act to the German Civil Code establishes that marriages entered abroad can be annulled if the contracting party had not reached the age of 18 at the time of the marriage.
Art. 13 Abs. 3 Einführgunsgesetz zum BGB (EGBGB) – in Kraft getreten am 22. Juli 2017
Art. 13 Abs. 3 EGBGB ist die zentrale Vorschrift zur Verhinderung von Kinderehen. Art. 13 Abs. 3 Nr. 1 EGBGB bestimmt, dass im Ausland wirksam geschlossene Ehen nach deutschem Recht unwirksam sind, wenn einer der Ehegatten zum Zeitpunkt der Eheschließung das 16. Lebensjahr noch nicht vollendet hat. Art. 13 Abs. 3 Nr. 1 EGBGB bestimmt, dass im Ausland geschlossene Ehen für nichtig erklärt werden können, wenn der Vertragspartner zum Zeitpunkt der Eheschließung noch nicht das 18. Lebensjahr vollendet hat.
