Case No. B 302-22

The Göta Court of Appeal case, B 302-22, concerned whether M.A. and R.B. had committed conspiracy to forced marriage by planning to compel their daughter, H.M., to travel to Pakistan to marry against her will. The Göta Court of Appeal found M.A. guilty, holding that he intended to exploit his daughter’s vulnerable situation to force her into a marriage or marriage-like union. His actions, including restricting her contact with the outside world, clearly demonstrated an attempt to control her life choices. He was sentenced to a conditional sentence for conspiracy to forced marriage. R.B. was acquitted of all charges due to insufficient evidence of her involvement in the plan.

Målet gällde frågan om M.A. och R.B. hade gjort sig skyldiga till stämpling till äktenskapstvång genom att planera att tvinga sin dotter, H.M., att resa till Pakistan för att ingå äktenskap mot sin vilja. Göta hovrätt fann att M.A. avsett att, genom att utnyttja sin dotters utsatta situation, förmå henne att ingå äktenskap eller en äktenskapsliknande förbindelse. Hans agerande, bland annat genom att begränsa hennes kontakt med omvärlden, ansågs visa på ett försök att kontrollera hennes livsval. Han dömdes därför för stämpling till äktenskapstvång till villkorlig dom. R.B. frikändes helt eftersom bevisningen inte var tillräcklig för att styrka hennes delaktighet i planerna.
