Case of M.G.C. v. Romania, European Court of Human Rights (2016)

In Case of M.G.C. v. Romania, an 11-year-old was sexually assaulted multiple times by a fifty-two-year-old man and five teenagers, resulting in her pregnancy. With the approval of her parents, she was able to terminate the pregnancy. The trial court initially determined they could not prove beyond a doubt that she did not consent to the sexual acts, and the Deva District Court found the man guilty of the criminal act of having sexual intercourse with a minor only (and not rape, since lack of consent was not proven) and he was sentenced to three years’ imprisonment. The Court considered it to be relevant that the girl was “scantily dressed” and that after she had allegedly been raped, she went on playing with her friends. The Hunedoara County Court subsequently allowed her appeal and convicted the man of rape and sentenced him to four years’ imprisonment. The judgment was further appealed, requesting an increase in the amount of non-pecuniary damage compensation and the imposition of a more severe sentence. The man also contested the judgment, requesting the original conviction for sexual intercourse with a minor, a crime to which he had confessed. The Alba Iulia Court of Appeal allowed the appeal on the man's arguments, and upheld the judgment of the Deva District Court as final, concluding that the sexual intercourse had been initiated by the girl on all occasions, and dismissed the submission that the victim lacked capacity to express her will. She appealed to the European Court of Human Rights (ECtHR) arguing that Romanian authorities had breached their positive obligation to protect her from inhuman and degrading treatment and to protect her right to respect for her private life. She argued that Romanian law and practice did not provide effective protection of children against rape and sexual abuse. The ECtHR found Romania in violation of its positive obligations under both Articles 3 and 8 of the Convention, including protecting minors’ rights, leading to a reopened case and a five-year sentence for the man.
