In this case, the claimants argued that the Comprehensive Organic Penal Code was unconstitutional because it did not include a special and expedited procedure for the prosecution of domestic and sexual violence crimes, as required under Article 81 of the Constitution. In contrast, the respondents claimed that the National Assembly, or legislature, had fulfilled its constitutional mandate, as the Comprehensive Organic Penal Code included normative provisions consistent with the subject matter provided in Article 81 of the Constitution. However, the Constitutional Court held that the legislature did not truly establish a special and expedited procedure for the prosecution of intrafamilial violence and, therefore, failed to fulfill its constitutional mandate. Consequently, the Court ordered the legislature to adopt such a procedure, in compliance with the Constitution, within one year of this decision. 

Las accionantes alegaron que el Código Orgánico Integral Penal era inconstitucional porque no incluía un procedimiento especial y expedito para el juzgamiento de los delitos de violencia doméstica y sexual, como exige el artículo 81 de la Constitución. Por el contrario, las autoridades demandadas afirman que la Asamblea Nacional, o el legislador, había cumplido su mandato constitucional, ya que el Código Orgánico Integral Penal incluía disposiciones normativas coherentes con la materia prevista en el artículo 81 de la Constitución. Sin embargo, la Corte Constitucional dictaminó que el legislador no estableció realmente un procedimiento especial y expedito para el juzgamiento de la violencia intrafamiliar y, por lo tanto, no cumplió con su mandato constitucional. En consecuencia, la Corte ordenó al legislador adoptar dicho procedimiento, en cumplimiento de la Constitución, en el plazo de un año desde esta decisión.
