In Case No. 187-2023, the Supreme Court of Chile ruled in a landmark gender justice case concerning the murder of a transgender woman. On May 16, 2023, the Oral Criminal Court of Iquique convicted the defendant of femicide. However, on October 4, 2023, the Iquique Court of Appeals overturned the conviction, holding that the victim did not legally qualify as a woman under the femicide statute because official records still listed her as male. After remand, the trial court once again convicted the defendant of femicide. In its decision, it reaffirmed the protections established under Law No. 21,120 (Gender Identity Law), emphasizing that the victim had long identified and been socially recognized as a woman, despite not having formally updated her legal name and sex. The Supreme Court upheld the conviction for femicide, underscoring the obligation of Chilean law to protect transgender individuals in line with constitutional principles of equality and international human rights standards.
La Corte Suprema resolvió un caso relevante en materia de justicia de género vinculado al asesinato de la mujer trans YP Torres. El 16 de mayo de 2023, el Tribunal Oral en lo Penal de Iquique condenó al acusado por femicidio. Sin embargo, la Corte de Apelaciones de Iquique revocó dicha condena el 4 de octubre de 2023, argumentando que la víctima no califica legalmente como mujer bajo el estatuto de femicidio, dado que en sus registros oficiales aún aparecía inscrita como hombre. Tras la devolución de la causa, el tribunal de primera instancia volvió a condenar al acusado por femicidio. En su fallo, reafirmó la importancia de las protecciones reconocidas por la Ley nº 21.120 (Identidad de Género), subrayando que la víctima se identificaba y era reconocida socialmente como mujer desde hacía años, pese a no haber realizado el cambio registral de nombre y sexo. La Corte Suprema validó esta interpretación, confirmando la condena por femicidio y destacando la necesidad de que el derecho chileno garantice la protección de las personas trans en concordancia con los estándares de igualdad y no discriminación.
