Caso Rol N° 190096-2023 Corte Suprema de Chile

In Case No. 190096-2023, the Supreme Court of Chile reviewed an appeal filed by a foreign woman who had been held in pretrial detention since April 8, 2023, on drug trafficking charges. The appellant was experiencing a high-risk pregnancy, with an expected due date of October 4, 2023, and was receiving medical care at the Provincial Hospital of Huasco. The Court examined and amended the November 15, 2023, ruling of the Court of Appeals of Concepción. The defense argued that the pretrial detention failed to consider a gender and intersectional perspective, given her status as an irregular migrant and her high-risk pregnancy. The legal frameworks cited included Article 19(7) of the Constitution, Articles 36 and 144 of the Code of Criminal Procedure, and international norms such as CEDAW, the Belém do Pará Convention, and the Bangkok Rules, all of which advocate for non-custodial measures for vulnerable women offenders. The Supreme Court found that the lower court’s decision lacked sufficient justification and failed to apply a gender perspective. It ordered the suspension of pretrial detention and mandated that less restrictive measures be considered at a new hearing. The Court also revoked the July 27, 2023, decision of the Court of Appeals of Copiapó, upheld the writ of amparo in favor of the appellant, and annulled the detention order. Justices Brito and Dahm dissented, voting to uphold the original ruling.
