Director of Public Prosecutions v. Quincy Kevin Edgecombe, Supreme Court of The Bahamas (2024)

Quincy Kevin Edgecombe, pleaded guilty to unlawful sexual intercourse under Sections 10(1)(a) and 11(1)(a) of the Sexual Offences Act. The Act criminalizes sexual intercourse with a person under the age of 14 regardless of consent and precludes any defense based on the accused’s lack of knowledge of the victim’s age. The victim, a 13-year-old girl, testified that she and Edgecombe communicated via Instagram and eventually met to have sexual intercourse at Edgecombe’s friend’s home. In determining his sentence, the Supreme Court of The Bahamas considered the four principles of sentencing: retribution, deterrence, reformation, and protection. The Court found that his prior convictions, the victim’s young age, the prevalence of sexual crimes, and the seriousness of the offense constituted aggravating factors in this case. The Court also identified some mitigating factors, primarily his young age (24) and his early guilty plea. The Supreme Court sentenced him to 10 years in prison with the recommendation of psychiatric treatment and vocational training.
