The Superior Court of Justice (STJ), unanimously, dismissed criminal proceedings for an alleged abortion induced by the pregnant woman herself. The Court ruled that the evidence was invalid because it had been provided by the physician who treated the patient, who is legally bound by professional confidentiality. The STJ also ordered that the documents be forwarded to the Regional Medical Council and the local Public Prosecutor’s Office for appropriate measures regarding the conduct of the physician who breached medical confidentiality by disclosing the alleged crime.
O Superior Tribunal de Justiça (STJ) decidiu, por unanimidade, trancar a ação penal que investigava suposto crime de aborto provocado pela própria gestante. O Tribunal entendeu que as provas utilizadas eram inválidas, pois haviam sido fornecidas pelo médico que atendeu a paciente, profissional que está legalmente obrigado a manter o sigilo sobre informações obtidas em razão da atividade médica. Além disso, o STJ determinou o envio dos documentos ao Conselho Regional de Medicina e ao Ministério Público local, para a apuração da conduta do médico que violou o dever de sigilo profissional ao divulgar a notícia de crime.
