KHO 2019:93
Supreme Administrative Court (2019)
The issue in KHO 2019:93 was whether an asylum seeker was allowed to present new grounds for their asylum application in the Supreme Administrative Court. The Finnish Immigration Service rejected the application for asylum and residence permit of a Somali citizen and her daughter and decided to deport them to Somalia. The Administrative Court dismissed their appeal. Before the Supreme Administrative Court, the Somali citizen raised a new fact in addition to those previously submitted, stating that there was concern that her daughter, who was born in Finland, could become subjected to genital mutilation and that the mother might be forced to undergo re-infibulation in Somalia if deported. In principle, the applicable rules require an asylum seeker to present all grounds for their application for international protection at the application stage rather than later, as the Somali citizen had done in this case. However, the Supreme Administrative Court held that an asylum seeker may not be aware that female genital mutilation constitutes a human rights violation or is a relevant factor in assessing the need for international protection. The sensitivity of the issue may also make it difficult for the applicant to raise the issue on their own initiative. Therefore, the Supreme Administrative Court held that the Somali citizen had a valid reason for raising new grounds for asylum only before the Supreme Administrative Court. The Supreme Administrative Court held that, considering the obligations of public authorities to safeguard fundamental and human rights (Article 22 of the Finnish Constitution (731/1999, as amended)), the duty of authorities to investigate (Article 7(2) of the Finnish Aliens Act (301/2004, as amended)) as well as international obligations, the Immigration Service should have, on its own initiative, investigated whether the daughter would be at risk of genital mutilation if returned to her home country. The Supreme Administrative Court thus overturned the decisions of the Immigration Service and the Administrative Court, referring the case back to the Immigration Service for reconsideration. This case was important because it ruled that the authorities must investigate the threat of female genital mutilation in an asylum process, even if the asylum seekers do not raise the issue themselves.
KHO 2019:93, Korkein hallinto-oikeus (2019)
