Law No. 30364, Law to Prevent, Penalize and Eradicate Violence Against Women and Family Group Members

The objective of Law No. 30364 is to prevent, eradicate, and penalize all forms of violence against women and family group members, especially those who are particularly vulnerable because of their age or physical attributes (e.g., children, adolescents, the elderly, and individuals with disabilities). The law recognizes that victims of abuse have the right to access information and advice through government services, free and immediate legal assistance, free medical attention and psychological treatment, and the right to retain their jobs and continue their schooling. The law sets forth the relevant legal procedures for bringing a complaint and potential protective measures. It also recognizes that the government is responsible for trying to prevent such violence. Specifically, the law tasks local and regional governments and the Ministry of Women and Vulnerable Populations to provide services such as temporary housing for victims and educational services to prevent violent behavior. The law also creates the National System for the Prevention, Punishment, and Eradication of Violence Against Women and Family Group Members. It also amends provisions of the Criminal Code, Criminal Procedure Code, and Civil Code, and repeals Law No. 26260. There have been several modifications to the law according to Legislative Decree 1323Legislative Decree No. 1386, and Law No. 30862
