New Jersey Revised Statutes § 47:1A-5.2 makes it a disorderly persons offense to knowingly disclose or distribute indecent or graphic images depicting another person’s intimate parts without that person’s prior written consent, or without consent from the next of kin if the individual is deceased. The term “disclose” encompasses any act of sharing or publishing, including posting the content online or making it accessible through digital platforms, whether or not it is for financial gain. Violations may result in fines and jail. The statute aims to protect personal privacy and dignity by criminalizing non consensual image distribution, commonly referred to as “revenge porn” and applies regardless of the intent to profit from the disclosure.
