Peruvian Penal Code (Legislative Decree 635) Title I-A: Crimes Against Humanity, Chapter II: Exploitation, Article 129-C, 129-F, 129-G, Article 129-E, Article 129-H, Article 129-I, Article 129-J, Article 129-K, Article 129-L: Sexual Exploitation
Article 129-C on Sexual Exploitation prohibits the use of violence, threats, deception, manipulation, or other means to force a person to engage in sexual acts with the intent to receive an economic or other benefit. The crime is punishable by 10 to 15 years imprisonment. Aggravating circumstances include committing the crime as part of the tourism industry or where the victim is under the perpetrator’s care or authority.
Articles 129-F and 129-G also punish anyone who benefits from or manages a sexual exploitation operation, even if they do not directly participate in it. Benefitting from sexual exploitation carries a sentence of 6 to 8 years imprisonment, while managing it carries a 10 to 15 years sentence. Article 129-E on Client of Sexual Exploitation prohibits the offering of economic or any other benefit to commit certain sexual acts against a victim of sexual exploitation. The crime is punishable by 9 to 12 years imprisonment.
Article 129-H on Sexual Exploitation of Children and Adolescents punishes anyone who makes a child or adolescent engage in sexual acts with the intent to obtain an economic or other benefit. A child or adolescent has no ability to consent to this crime. The crime is punishable by 15 to 20 years imprisonment. Aggravating circumstances include situations where the victim is in a situation of abandonment or extreme economic necessity, or if the victim is younger than 14-years-old. The promotion of facilitation of this crime is also punishable under Article 129-I. Articles 129-J, 129-K and 129-L, respectively, further punish clients of such children and adolescents, anyone who benefits from their sexual exploitation, or anyone who manages a sexual exploitation operation.
