Peruvian Penal Code Title I: Crimes Against Life, Body, and Health, Chapter I: Homicide, Article 108-B: Femicide, punishes the crime of femicide with imprisonment of no less than 20 years. femicide means killing a woman because of her identity as a woman, and it applies in several contexts: family violence, coercion, harassment or sexual harassment, abuse of power, trust or any other position or relation which places the agent in a position of authority. It includes any form of discrimination against women, regardless of whether there exists or existed a spousal or cohabitant relationship with the perpetrator. Aggravating circumstances that increase the prison sentence to at least 30 include: if the victim is underage or an elder; if the victim was pregnant; if the victim was under the care or responsibility of the agent; if the victim was previously subjected to sexual assault or mutilation; if at the time the crime was committed, the victim had any form of incapacity; if the victim was subject to human trafficking or any form of human exploitation; if the crime was committed in the presence of a child or adolescent; and if the agent under the influence of drugs or alcohol. If two or more of these aggravating circumstances exist, the penalty is imprisonment for life.
