Republic v. Mwakeran [2019] KIHC 51
Republic v. Mwakeran is an appeal by the prosecution against a Magistrates’ Court decision dismissing charges of indecent assault, domestic violence, and common assault for non-appearance of the prosecution. In this case, the defendant faced three charges: indecent assault under section 133(1) of the Penal Code, domestic violence under section 33(2) of the Te Rau N Te Mwenga Act 2014 (formerly referred to as the Family Peace Act 2013), and common assault under section 237 of the Penal Code. The allegations involved inappropriate touching and assaults with a water tank pipe on multiple occasions. The Magistrates’ Court dismissed the case after the prosecution failed to appear on two occasions. On appeal, the High Court held that the power to dismiss for non-appearance is discretionary and should be exercised only when appropriate in light of the circumstances. Since the prosecution had already called the victim as a witness and she had given testimony establishing a prima facie case, dismissal was not justified. The High Court set aside the dismissal and remanded the case for hearing on the merits. This case clarified that dismissal for non-appearance of the prosecution is not automatic but a discretionary power to be used sparingly, ensuring that serious charges, particularly involving sexual and domestic violence, are not prematurely terminated where prima facie evidence exists.
