Nález Ústavního soudu ze dne 24. dubna 2024, sp. zn. IV.ÚS 3248/24 (2025)

Ruling of the Constitutional Court of the Czech Republic, No. 4. ÚS 3248/24 (2025) on the right to adequate rape investigations.

A couple had previously engaged in certain Bondage, Discipline/Dominance, Submission, Sadism, and Masochism (BDSM) practices during their long-term relationship. They went on a trip to a secluded cabin. According to the complainant, the boyfriend/suspect wanted to have sex, but she refused. He then forced intercourse while she tried to defend herself. After this, they went to sleep, and he forced intercourse again in the morning and later in the day. Afterwards, they left the cabin, and the victim reported the rape to the police. The police, however, found that since the couple had engaged in consensual BDSM practices during the relationship, the man believed that the woman had consented to the intercourse (i.e., that her refusal was only a part of the consensual BDSM practice). The police also found that since she had voluntarily stayed in the cabin even after the first alleged rape, it was unlikely that the sex was not consensual. She challenged the handling of the case by authorities before the Constitutional Court. The complainant argued that the authorities failed to properly investigate the case, as the couple had never engaged in any “rape roleplay” practices, and therefore, there was no misunderstanding of consent. She also argued that the authorities based their decision on common stereotypes of victim behavior after rape, in that her failure to leave was taken as evidence of consent. The Constitutional Court held in favor of the complainant, that the authorities must investigate the case further. The fact that a couple engages in BDSM practices does not mean that a partner cannot know whether the other partner consents to the intercourse. BDSM couples establish specific ways to express and communicate their consent beforehand. In this case, there was no evidence that the couple had ever engaged in any rape roleplay, and thus, the man would have known that the sex was not consensual. The Constitutional Court also affirmed that the victim did present the reasons for her own behavior in not leaving; the police file indicated that she did report that she was very afraid of the suspect, she could not find her phone in the cabin, she was naked, it was very cold outside, and the cottage was secluded, with the nearest village being a twenty to thirty minute walk away, where she did not know anyone. Her behavior was not evidence of consent to the intercourse, and this is common behavior among victims.

Poté šli spát a muž ji údajně donutil k pohlavnímu styku znovu ráno a později během dne. Následně chatu opustili a žena znásilnění oznámila policii.
