Resolution of the Supreme Court of the Czech Republic, No. 8 Tdo 699/2021 (2021) on the element of coercion in forcible rape.
A taxi driver drove the victim to a remote location instead of to her home and then demanded sexual services in place of the fare. The victim was unable to speak or to resist physically due to stress. She froze in the fetal position in the back of the vehicle. The driver proceeded to get into the back seat and sexually assault her. The trial court convicted the driver of rape under Section 185(1) and (2)(a) of the Criminal Code. The driver argued that the absence of any verbal refusal or active resistance meant the element of coercion was not met. This appeal was dismissed by both the appellate and Supreme Court. The Supreme Court held that a victim of rape who, as a result of stress, is unable to communicate verbally and can only express herself through behaviour, in particular through body language in the form of a passive defensive position, preventing sexual intercourse. The perpetrator fulfils the element of coercion by forcibly changing the victim's position so that he can have intercourse.
1 a odst. 2 písm. a) trestního zákoníku.
