The Constitution sets forth the Argentine Republic’s fundamental principles, values, norms, and guarantees, including (among other enumerated rights and protections) the following:
Article 75(23) empowers the State to legislate and promote positive measures guaranteeing equal opportunities, equal treatment, and the full benefit and exercise of the rights recognized by the Constitution and the international human rights treaties in force, in particular with respect to women. It also requires the establishment of a special and integral social security system to protect mothers during pregnancy and for their period of lactation.
Article 16 enshrines the right to work and the concept that all Argentines are “equal before the law.” Further, Article 16 ensures equality as the basis of taxation and government functions. Article 14bis ensures “equal pay for equal work,” among other labor, union, and social security protections.
Article 37 guarantees the full exercise of political rights, in accordance with the principle of popular sovereignty and the laws that are enacted accordingly. Suffrage is universal, equal, secret, and obligatory. The state must guarantee equal opportunity for men and women to access elective and political party positions.
Article 75(22) grants certain international human rights conventions constitutional status in the Argentine legal hierarchy, including the Universal Declaration of Human Rights, the Convention on the Elimination of all Forms of Discrimination against Women, and the American Convention on Human Rights, among others. Article 75(24) allows for the approval of other international treaties that are granted legal status with higher standing than statutory law passed by the Argentine Congress.

La Constitución establece los principios, valores, normas y garantías fundamentales de la República Argentina, incluidos (entre otros enumerados derechos y protecciones) los siguientes: El artículo 75(23) le da el poder al Estado para legislar y promover medidas positivas que garanticen la igualdad de oportunidades, la igualdad de trato y el pleno beneficio y ejercicio de los derechos reconocidos por la Constitución y los tratados internacionales de derechos humanos vigentes, en particular respecto de las mujeres. También requiere el establecimiento de un sistema de seguridad social especial e integral para proteger a las madres durante el embarazo y durante su período de lactancia.
El artículo 16 consagra el derecho al trabajo y el concepto de que todos los argentinos son “iguales ante la ley”. Además, el artículo 16 garantiza la igualdad como base de los impuestos y de las funciones gubernamentales. El artículo 14 bis garantiza “la igual remuneración por igual trabajo”, entre otras protecciones laborales, sindicales y de seguridad social.
El artículo 37 garantiza el pleno ejercicio de los derechos políticos, en concordancia con el principio de soberanía popular y con las leyes que se promulguen en consecuencia. El sufragio es universal, igualitario, secreto y obligatorio. El Estado debe garantizar la igualdad de oportunidades entre hombres y mujeres para acceder a puestos electivos y partidistas.
El artículo 75(22) otorga rango constitucional en la jerarquía jurídica argentina a ciertas convenciones internacionales de derechos humanos, incluidas la Declaración Universal de los Derechos Humanos, la Convención sobre la Eliminación de Todas las Formas de Discriminación contra la Mujer y la Convención Americana sobre Derechos Humanos. El artículo 75(24) permite la aprobación de otros tratados internacionales a los que se les otorgue rango jurídico superior a la ley estatutaria aprobada por el Congreso argentino.
