This case concerned the capacity and dignity of mothers with disabilities. A mother with disabilities lost custody of her child, and the child was subsequently put up for adoption by a child welfare agency because of her disability, and the child’s illness, in violation of her rights. The Constitutional Court reinstated the mother’s parental rights of her child reasoning that the best interests of the child must be protected, the right to have a family is a guarantee, and they should not be separated from it, and in compliance with all of the state’s obligations towards people with disabilities and their right to form a family with dignity. The Court ordered the Ombudsman’s Office to compose a committee consisting of a doctor, psychologist, and a social worker to follow up with the mother and identify the obstacles and specific problems that she may have in the exercise of her responsibilities when raising her child.

Este caso versaba sobre la capacidad y la dignidad de las madres con discapacidad. Una madre con discapacidad perdió la custodia de su hijo, quien posteriormente fue dado en adopción por una agencia de bienestar infantil debido a la discapacidad de la madre, en violación de sus derechos. El Tribunal Constitucional restituyó la patria potestad de la madre sobre su hijo, argumentando que el interés superior del menor debe ser protegido, que el derecho a formar una familia es un derecho fundamental y que el niño no debe ser separado de su madre, en cumplimiento de todas las obligaciones del Estado hacia las personas con discapacidad y su derecho a formar una familia. El Tribunal ordenó a la Defensoría del Pueblo que conformara un comité integrado por un médico, un psicólogo y un trabajador social para supervisar a la madre e identificar cualquier obstáculo o problema específico que pudiera enfrentar en el cumplimiento de sus responsabilidades en la crianza de su hijo.
