State of Washington v. Hodgins, 190 Wash. App. 437 (2015)

Hodgins had prior misdemeanor convictions for domestic violence when the state of Washington brought charges against him for violating an order of protection on seven separate occasions. Hodgins pled guilty to two of the seven counts of domestic violence, but the Court did not include his prior misdemeanor convictions in its calculation of his offender status for purposes of sentencing pursuant to RCW 9.94A.525. The Court of Appeals found that, under the facts of the case and relevant Washington law, Hodgins should have received an extra point on his offender status for any prior repetitive domestic violence offenses. Accordingly, the trial court erred in failing to consider his convictions in determining his offender status at sentencing. The Court of Appeals reversed and remanded the case for sentencing with a higher offender status.
