Ala. Admin. Code r. 335-3-16-.06 - Federally Enforceable Requirements
(1) All terms in a permit that are required
to be part of a permit pursuant to the Act are federally enforceable by EPA,
the Department and citizens in general. However, those provisions of a permit
that are not required under the Act are considered to be state permit
provisions and consequently, are not federally enforceable by EPA and citizens
in general.
(2) Those provisions of
a permit that are state provisions shall be separated from the federally
enforceable terms. Such state provisions shall be clearly identified in the
permit.
