17 AAC 45.800 - Purpose
(a) The purpose of
17 AAC 45.800 -
17 AAC 45.810 is to regulate the
conduct of first amendment activity at an airport, but to avoid any inference
of intended or inadvertent designation of any part of an airport as a public
forum.
(b) A first amendment
activity on an airport must not interfere with the primary transportation
function of an airport facility or with the ability of the department to carry
out the following objectives:
(1) ensure that
passengers, airport employees, lessees, permittees, concessionaires, and the
public can use an airport facility safely, conveniently, and
efficiently;
(2) prevent
interference with the rights of passengers to have unobstructed access to
public areas of an airport facility and to avoid undue delay in passage within
and between facilities;
(3) reduce
opportunities for a traveler, and particularly a traveler unfamiliar with the
currency or customs of the United States, to be deceived or improperly
restrained by any individual or group at an airport facility;
(4) prevent interference with emergency,
anti-hijack, and other security procedures at an airport;
(5) avoid impairment of the financial
self-sustainability of the airport.
(c) The provisions of
17 AAC 45.800 -
17 AAC 45.810 apply to a first
amendment activity conducted anywhere on an airport except in an area that is
restricted or otherwise closed to the public.
