7 AAC 100.104 - Mandatory members of the household
(a) Unless
otherwise provided in this chapter, the following individuals are mandatory
members for the household for the purposes of determining Family Medicaid
eligibility if they are living in the same home:
(1) a dependent child; to be determined a
dependent child, an individual must be deprived of parental support and care
under 7 AAC 100.106, and must be
(A) under 18 years of age; or
(B) under 19 years of age and enrolled
full-time in a secondary school or in the equivalent vocational or technical
training;
(2) except as
provided in
7 AAC 100.120(a) (6), a sibling of a
dependent child under (1) of this subsection if the sibling is also a dependent
child;
(3) a parent of a dependent
child under (1) of this subsection, even if the parent is temporarily absent as
described in
7 AAC 100.112.
(b) Except as provided in (c) of this
section, the department will deny eligibility if the applicant fails to
identify an individual who is a mandatory member of the household or fails to
provide all of the information requested by the department to verify the
eligibility of each mandatory member of the household.
(c) If the department is unable to verify the
relationship between a child and the child's caretaker relative or between the
child and other children who are mandatory members of the household, the
department will proceed with providing benefits to the other eligible children
who are mandatory members of the household if the applicant is cooperating with
the department in securing the necessary verification and is not attempting to
exclude the child merely by withholding verification. Until the department
verifies the child's relationship to the caretaker relative and the other
children in the household, the department will not consider the child to be a
mandatory member of the household.
(d) When the parent of a dependent minor
parent applies for Family Medicaid benefits on behalf of the minor parent, the
dependent child of the dependent minor parent is considered an optional member
of the household and may be included in the Family Medicaid household under
7 AAC 100.116, if all three individuals are living in
the same home.
