7 AAC 100.756 - Special low-income Medicare beneficiary qualifying individual
(a) To be
eligible as a special low-income Medicare beneficiary qualifying individual
under 7 AAC 100.002(e)
(4), an individual must
(1) be eligible for and enrolled in Medicare
Part A hospitalization coverage;
(2) have total monthly income that does not
exceed 135 percent of the federal poverty guidelines for this state, adopted by
reference in
7
AAC 100.980;
(3) have countable resources that do not
exceed $4,000 for an individual living alone or $6,000 for spouses living
together; and
(4) meet all other
nonfinancial eligibility requirements under
7
AAC 100.400.
(b) Coverage for an individual eligible under
this section is limited to payment of the individual's Medicare Part B
premiums.
(c) An individual that
the department determines is eligible under this section may apply for up to
three months of retroactive eligibility under
7
AAC 100.072, but retroactive eligibility is not
available for any month before January 1 of the year in which the individual
applies for retroactive eligibility.
(d) The department will provide coverage
under this eligibility category until the department reaches the annual
spending limit established under
42 U.S.C.
1396u-3. If the department reaches the
spending limit under 42
U.S.C. 1396u-3 before the end of a calendar
year, the department will stop determining eligibility under this eligibility
category, but will instead determine eligibility under
7
AAC 100.754.
