7 AAC 53.135 - Repayment of overpayments
(a) The department
may pursue repayment under this section from a current or former foster parent
who received an overpayment, regardless of whether the overpayment was the
result of an administrative error or oversight by the department .
(b) To request repayment under this section,
the department will send an overpayment notice to the current or former foster
parent. In the overpayment notice, the department will
(1) identify the overpayment
amount;
(2) provide the detail of
the overpayment; and
(3) inform
the foster parent of the right to request a review under

AAC 54.500 or an evidentiary hearing under
7
AAC 54.510 if the foster parent disagrees with the
findings.
(c) A current
or former foster parent may choose to repay the entire amount of an overpayment
(1) in a single payment;
(2) in monthly installment payments; or
(3) by offsetting future foster
care payments.
(d) In
this section, "overpayment" means a payment to a current or former foster
parent to which the foster parent was not legally
entitled.
