18 AAC 60.505 - General requirements
(a) Regulations of
the federal government for land application of biosolids in 40 C.F.R, 503.8
(sampling and analysis), revised as of March 26.2007,40 C.F.R. 503.9 (general
definitions), revised as of August 4,1999, 40 C.F.R. Part 503, Subpart B (land
application) and Subpart D (pathogens and vector attraction reduction), revised
as of October 22, 2015, and 40 C.F.R. Part 503, Appendices A and B, revised as of
August 4,1999, are adopted by reference.
(b) A person may not apply biosolids to land
unless
(1) the concentration of metals in the
soil is below, and will remain below, the limits set in 40 C.F.R. 503.13, Table
1, revised as of August 4,1999;
(2)
the project is consistent with the management practices in 40 C.F.R. 503.14,
revised as of August 4,1999;
(3) the
concentration of metals in the biosolids is less than the limits set in 40 C.F.R.
503.13, Table 1, revised as of August 4,1999;
(4) the biosolids have been treated to meet the
pathogen reduction requirements of 40 C.F.R. 503.15(a), revised as of August
4,1999; and
(5) the biosolids have
been treated to meet the vector attraction requirements of 40 C.F.R. 503.15(c),
revised as of August 4,1999.
(c) Except as provided in 18 AAC 60.510(b), a
person may not place biosolids on the land of the state without first obtaining a
permit from the department.
